1. Acceptance
By accessing or using Property Command ("the Service", "we", "us"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree, you must not use the Service. These terms apply to users worldwide; jurisdiction-specific rights are set out in sections 10β14 and are preserved in full regardless of any conflicting clause.
2. Description of Service
Property Command is a cloud-based property portfolio management platform that allows users to track, analyse, and manage investment properties. The Service is provided for informational and organisational purposes only. Nothing in the Service constitutes financial, investment, legal, taxation, or real estate advice. You should seek independent professional advice before making any investment decision.
3. Eligibility
You must be at least 18 years of age to create an account and use the Service. In the United States, the Service is not directed at persons under 13 and we do not knowingly collect personal information from children under 13 in compliance with COPPA. In the European Union, users must be at least 16 years of age, or the minimum age required in their member state, to consent to data processing.
4. User Accounts
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised access. We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or pose a security risk.
5. Acceptable Use
You may not use the Service for any unlawful purpose, transmit harmful or fraudulent data, attempt to reverse-engineer or disrupt the platform, process third-party data without consent, or facilitate financial crime.
6. Intellectual Property
Property Command and its software, design, and trademarks are owned by or licensed to us. You retain full ownership of all data you enter. You grant us a limited, non-exclusive licence to store and process your data solely to deliver the Service.
7. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis without warranty of any kind. Property valuations, yield estimates, cashflow projections, and capital growth calculations are indicative only and based on data you provide.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Property Command shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim. Nothing limits liability for death, personal injury, or fraud caused by our negligence.
9. Third-Party Services
The Service integrates with third-party infrastructure including Supabase. We are not responsible for the availability or practices of third-party services. Providers are required to handle your data in accordance with applicable privacy laws.

10. Australian Consumer Law
The Australian Consumer Law (ACL) may provide guarantees that cannot be excluded for Australian consumers. You may be entitled to remedies including repair, replacement, or refund for a major failure. Nothing in these terms is intended to exclude, restrict, or modify any right or remedy you may have under the ACL.
11. Australian Privacy
We comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). Complaints may be referred to the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.
12. New Zealand Consumer Rights
The Consumer Guarantees Act 1993 (CGA) and Fair Trading Act 1986 (FTA) may apply. Where the CGA applies as a consumer transaction, guarantees of acceptable quality and fitness for purpose cannot be contracted out of.
13. New Zealand Privacy
We comply with the Privacy Act 2020 (NZ) and the 13 Information Privacy Principles (IPPs). Complaints may be lodged with the New Zealand Privacy Commissioner at privacy.org.nz.
14. UK Consumer Rights
The Consumer Rights Act 2015 applies to UK consumers. Digital services must be supplied with reasonable care and skill, and be as described. Nothing in these terms affects your statutory rights.
15. UK Data Protection
We comply with the UK GDPR and the Data Protection Act 2018. You have the right to access, rectify, erase, restrict, and port your personal data. Complaints may be submitted to the ICO at ico.org.uk.
16. EU Consumer Rights & Right of Withdrawal
EU consumers have a 14-day right of withdrawal from the date of contract conclusion under the Consumer Rights Directive (2011/83/EU), unless you have consented to immediate supply and acknowledged the withdrawal right is lost on full performance.
17. EU GDPR
We act as data controller. We process data under Article 6(1)(b) and (f) GDPR. You have rights of access (Art. 15), rectification (Art. 16), erasure (Art. 17), restriction (Art. 18), portability (Art. 20), and objection (Art. 21). You may lodge a complaint with your national supervisory authority.
18. US State Privacy Rights
California residents have rights under CCPA/CPRA including to know, delete, opt-out of sale, correct, and non-discrimination. We do not sell personal information. Residents of Virginia, Colorado, Connecticut, Texas, and other states with applicable privacy laws have similar rights.
19. COPPA
The Service is not directed at children under 13. We do not knowingly collect personal information from children under 13. Parents may contact us at hello@propertycommand.io.
20. US Disclaimer
TO THE FULLEST EXTENT PERMITTED BY US LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED. SOME STATES DO NOT ALLOW EXCLUSION OF IMPLIED WARRANTIES, SO THESE MAY NOT APPLY TO YOU.
21. Dispute Resolution
Contact us first at hello@propertycommand.io. EU consumers may use ec.europa.eu/consumers/odr. UK consumers may refer to an approved ADR scheme. Nothing affects your right to bring a claim before a court of competent jurisdiction.
22. Governing Law
These terms are primarily governed by the laws of New South Wales, Australia. This does not deprive you of mandatory consumer protections under the laws of your country of residence.
23. Severability
If any provision is found invalid or unenforceable, it shall be modified to the minimum extent necessary, and the remaining provisions continue in full force.
24. Changes to Terms
We may update these terms. For material changes, we will provide at least 30 days' notice via email or in-app notice. Continued use after the effective date constitutes acceptance.
